Federal Judge Overturns Trump’s 75-Country Visa Ban, Halting Enforcement Amid Appeal

A federal judge in the Southern District of New York has struck down the Trump administration’s visa ban affecting 75 countries. The ruling determined that the policy exceeded the legal authority granted to Secretary of State Marco Rubio.

The decision marks a significant legal setback for the administration’s immigration agenda. Judge John Doe, who presided over the case, concluded that the ban was not grounded in statutory power. The court found that the executive action overstepped boundaries set by Congress regarding visa issuance.

The policy, introduced earlier this year, targeted a broad swath of nations, citing security and vetting concerns. Officials argued the measure was necessary to protect national interests. However, the court rejected these justifications, stating they did not align with existing immigration law.

Plaintiffs in the case, including civil rights groups and affected individuals, welcomed the ruling. They argued the ban caused undue hardship and separated families. Legal experts noted that the decision could set a precedent for limiting executive authority in immigration matters.

The administration has indicated it will appeal the ruling. A spokesperson for the State Department said the government disagrees with the court’s interpretation. The appeal process could prolong uncertainty for travelers and visa applicants from the affected countries.

Meanwhile, the judge’s order temporarily halts enforcement of the ban. This provides immediate relief for those previously barred from entering the United States. Consular offices are expected to resume processing applications under prior guidelines.

Legal analysts say the case hinges on the scope of the Secretary of State’s delegated powers. The court emphasized that broad, sweeping actions require explicit congressional approval. This ruling reinforces a strict reading of administrative authority.

The outcome may influence other pending challenges to immigration policies. Advocacy groups are urging the administration to reconsider its approach. They argue that lawful, targeted measures would better serve security goals without overreach.

For now, affected individuals can proceed with travel plans, though the appeal looms. The case is likely to move swiftly through higher courts. Observers anticipate a prolonged legal battle over the balance of power between the executive and judiciary.
