‘There might be a silver lining’: My friend’s wife died at 60 after a high-earning career. Can he claim her Social Security?

A surviving spouse may claim Social Security benefits based on the deceased worker’s record. Eligibility depends on the survivor’s age, the length of the marriage, and the worker’s earnings history. A marriage lasting more than 30 years meets the duration requirement for survivor benefits.

Survivor benefits become available as early as age 60, though claiming before full retirement age reduces the payment. A surviving spouse can also receive benefits at any age if caring for the worker’s child under 16. The exact amount varies based on the survivor’s age at the time of claim.

The deceased wife earned a high income during her career. Higher lifetime earnings generally translate into a larger benefit for survivors. The husband’s own work history also affects the final calculation. He may receive either his own retirement benefit or the survivor benefit, whichever is higher.

Social Security does not pay both benefits at once. The agency pays the larger of the two amounts. This rule is known as the dual entitlement provision. It ensures survivors receive the most favorable payment available.

If the husband has reached full retirement age, he can step up to the full survivor benefit. Claiming earlier locks in a permanently reduced amount. Full retirement age for survivor benefits ranges from 66 to 67, depending on birth year. Waiting until that age maximizes the monthly payment.

A one-time death payment of $255 is also available to a surviving spouse. This lump sum is separate from monthly survivor benefits. It must be claimed within two years of the death. The payment goes to the spouse who lived with the worker at the time of death.

The husband should contact the Social Security Administration to confirm his eligibility. Documents needed include the marriage certificate and the wife’s death certificate. The agency can calculate the precise benefit based on both work records. Filing promptly helps avoid gaps in payment.

Survivor benefits can provide meaningful financial support after a spouse’s death. For a high-earning couple, the survivor benefit may be substantial. Consulting a Social Security specialist can clarify the best claiming strategy.
