Pentagon’s Anthropic Blacklist Upheld by Federal Appeals Court

A federal appeals court ruled that the Pentagon was legally allowed to blacklist Anthropic, an artificial intelligence company. The decision came from a Washington-based appeals court on September 25, 2026.

The court found the Pentagon had sufficient grounds to conclude Anthropic’s products posed a national security risk. Judges determined the agency acted within its legal authority.

The dispute centered on whether the Defense Department could restrict contracts with the A.I. firm. Anthropic had challenged the blacklisting as improper and overly broad.

Federal judges disagreed with the company’s arguments. They cited “ample support” for the Pentagon’s national security concerns in the ruling.

The case highlights growing scrutiny of A.I. companies working with government agencies. National security reviews now play a major role in defense contracting decisions.

Anthropic has not announced whether it will appeal the ruling further. The company can still seek review from the Supreme Court or file a new challenge.

The decision may influence how other A.I. firms handle government contracts and security compliance. It also reinforces the Pentagon’s broad discretion in vetting technology vendors.
