Judge Backs DOJ Subpoena for Times Freelancer in Press Freedom Case

A magistrate judge has recommended that a freelance reporter for The New York Times comply with a Justice Department subpoena. The ruling favors federal prosecutors seeking information about the reporter’s sources.

The decision remains a recommendation, not a final order. A Federal District Court judge will review the matter at a hearing scheduled for next month.

The dispute centers on the scope of press protections for independent journalists. Freelancers often lack the institutional legal backing available to staff reporters at major outlets.

Prosecutors argue the subpoena is necessary for an ongoing investigation. They contend the requested information cannot be obtained through other means.

The case now moves to the district court judge, who holds final authority. That judge may accept, reject, or modify the magistrate’s recommendation.
