One outdated form can override your will and send your savings to the wrong person. Here’s how to fix it.

A single beneficiary designation error can redirect your life savings away from the people you intended to protect. Estate-planning problems rarely stem from bad intentions. They usually come down to small oversights that go unnoticed for years.

Beneficiary forms on retirement accounts and insurance policies override your will. Whoever is named on the form receives the money, regardless of what your will says. An outdated form can send your estate to an ex-spouse or a deceased relative’s heirs.

Many people fill out these forms once and never revisit them. Life changes such as marriage, divorce, or a death in the family often go unrecorded. The result is a payout that contradicts your current wishes and creates conflict among survivors.

Primary and contingent beneficiaries both matter. If the primary beneficiary has died, the contingent beneficiary steps in. Leaving that section blank can push the assets into probate, where a judge decides the outcome.

Probate adds time, cost, and public exposure to the process. Court fees and legal bills can eat into what your family receives. The proceedings also become part of the public record, which many families prefer to avoid.

Reviewing your designations takes only a few minutes per account. Financial institutions allow updates online or through a simple form. Advisors recommend checking them after every major life event.

Some accounts require a spouse’s written consent to name someone else. State law and employer plan rules can limit your options. Confirm the requirements before filing any change.

Coordinating beneficiary forms with your overall estate plan prevents gaps. A will, a trust, and these forms should all tell the same story. When they conflict, the beneficiary form almost always wins.
