Supreme Court Upholds Mail-Order Access to Abortion Pill Mifepristone

The Supreme Court has ruled to maintain access to the abortion pill mifepristone by mail. The decision blocks a federal appeals court ruling that would have restricted that access. The case centered on challenges to Food and Drug Administration regulations.

The appeals court ruling had targeted an FDA policy allowing mifepristone to be prescribed via telehealth and delivered by mail. That policy was established in 2021 during the pandemic. The Supreme Court’s action keeps that rule in place for now.

Mifepristone is a key drug used in medication abortion, which accounts for a majority of terminations nationwide. The medication is approved for use up to ten weeks of pregnancy. The FDA has deemed it safe and effective after decades of data.

Anti-abortion groups had sued the FDA, arguing the agency overstepped its authority by easing restrictions. They claimed the mail-order rule lacked proper safeguards. The Supreme Court did not rule on the merits, setting the case for further proceedings.

The ruling allows the current system to continue while the legal battle moves forward. Patients can still get a prescription through an online consultation. The medication is then shipped to their homes.

The decision has immediate practical effects for many people. It ensures continued access for those in states where abortion is legal. It adds certainty for providers and patients amid ongoing litigation.

Other FDA regulations on mifepristone remain intact. These include in-person dispensing requirements from before 2021. The case will likely return to lower courts for more arguments.
