Federal Lawsuits Challenge Virginia and California Assault Weapon Bans Under Second Amendment

The Justice Department has filed lawsuits against Virginia and California, challenging state-level gun restrictions as violations of the Second Amendment. The legal actions target a ban on semiautomatic assault rifles in Virginia and a ban on Glocks and Glock-style pistols in California. Both cases argue the firearms are commonly used for lawful purposes, including self-defense.

The Trump administration initiated the suits in late June, marking a significant federal intervention in state gun policy. Officials claim the bans infringe on citizens’ rights to keep and bear arms, as recognized by recent Supreme Court precedent. The lawsuits seek to block enforcement of the laws in both states.

Virginia’s law prohibits the sale and possession of many semiautomatic rifles, including AR-15 style weapons. The state legislature passed the measure earlier this year, citing public safety concerns following mass shootings. California’s ban targets handguns with certain design features, effectively barring many Glock models from sale.

Legal experts note these cases test the boundaries of the Second Amendment after the 2022 Supreme Court ruling in *New York State Rifle & Pistol Association v. Bruen*. That decision required gun laws to be consistent with historical tradition. Both Virginia and California have defended their laws as longstanding safety measures.

The Justice Department argues the banned firearms are widely owned and used for sport and protection. Statistics cited in the lawsuits show millions of semiautomatic rifles and Glock-style pistols are in circulation nationwide. The government contends that such common use protects them under constitutional law.

State officials in Virginia and California have vowed to fight the lawsuits. They emphasize the laws were democratically enacted and respond to gun violence crises. California’s attorney general stated the state will vigorously defend its public safety laws.

The outcomes could set precedents for similar gun restrictions across the country. Several states have considered or enacted analogous bans in recent years. These cases may ultimately reach the Supreme Court for a final determination on the limits of Second Amendment protections.
