States and Cities Sue Over Trump’s Green Card Public Benefits Rule

California and several cities filed a lawsuit on Monday challenging a Trump administration policy that would restrict green cards for immigrants who use public benefits. The plaintiffs argue the rule exceeds federal authority and threatens public health. The case was filed in federal court in San Francisco.

The policy, finalized last month, grants immigration officers broad discretion to deny permanent residency. Applicants could be rejected for using Medicaid, food stamps, or housing assistance. Officers would weigh benefit use as a negative factor in green card decisions.

Immigration officials say the rule ensures immigrants are self-sufficient. They argue it protects taxpayer resources and encourages financial independence. Critics counter that the policy penalizes working families and children.

The lawsuit claims the administration violated the Administrative Procedure Act. Plaintiffs say the rule was issued without proper public comment. They also argue it conflicts with existing immigration law.

States and cities warn of widespread consequences. Millions of immigrants could avoid benefits they legally qualify for. That would strain hospitals, schools, and local health programs.

Similar lawsuits have been filed by other states and advocacy groups. Legal challenges are expected to consolidate in the coming weeks. A nationwide injunction could block the policy before it takes effect.

The case highlights a broader battle over immigration enforcement. The administration has pushed stricter rules throughout Trump’s term. Opponents say the policy targets low-income and minority communities.

A federal judge will hear arguments next month. The outcome could reshape how public benefits factor into immigration decisions. Both sides agree the case will likely reach the Supreme Court.
